Marriage Licenses
The first step in applying for a marriage license is to complete a Marriage License Application. You can do this in one of two ways:
- Save time and apply online using our eMarriage Application. Once you complete the online application, you will receive a confirmation notice containing information about completing the application process.
- Print the Marriage License Application and bring it to the Orange County Courthouse to complete the process.
Please note that for both methods indicated above, the 3-day waiting period does not begin until after the couple comes together to the Clerk’s office and purchases the marriage license in person. Passports Applications
All those traveling outside the United States need a passport to re-enter the country, including those traveling to Canada, Bermuda and the Caribbean.
When applying for a passport, two separate fees and forms of payment are required. Be sure to review the accepted forms of payment.

Traffic
Welcome to the Orange County Clerk of Courts Traffic Division. If you have recently received a traffic ticket, please review the information provided to determine which traffic option applies to you.
- Fines for cases turned over to collection agencies: Payment must be made directly to the collection agency. Collection agency information is available on our traffic ticket options page.
- Cases that require a court appearance
- Cases where Restitution was ordered to be paid to a victim
- Cases where a credit card was previously reversed
- Toll Violations (by camera) less than 75 days past due: Toll violations can be paid by mail or in person at one of our locations. Please include the citation number when making a payment. *Please note: Toll violations that are 75 days past due may be paid online.
- Visa, MasterCard, Discover or American Express card (a $3.50 surcharge will apply)
- Valid billing address and CVV number (the 3-digit security code on the back of your card)
- Case or citation number (It can take up to 10 days for our system to receive a citation from an issuing law enforcement agency. If you cannot initially find your citation online, consider searching again in a few days.)

Late fees and suspension may apply if you do not elect a traffic option within 30 calendar days from the date of citation.

Dissolution of Marriage
Forms
Forms and filing instructions may be purchased in room 320 or 340 of the Orange County Courthouse or a dissolution of marriage packet can be purchased online from The Clerk of Courts site. Customers may obtain individual forms by visiting flcourts
Filing for Divorce
- Take completed forms to room 340 of the courthouse before 3:30 p.m. to be reviewed and notarized
- Once the case is filed, Family Court Services will contact the petitioner with instructions
- If no further filing is required, the petitioner will receive a hearing date and time by mail
Name Change
Requirements
Before a name change hearing can be set, the petitioner must have fingerprints taken electronically by an authorized agency.
The fingerprints are then submitted to the Florida Department of Law Enforcement (FDLE) and the Federal Bureau of Investigation (FBI) for criminal history records checks. The results are sent to the Clerk’s Office by FDLE.
A background check is not required for petitions to restore a former name or for changes of name in proceedings for divorce or adoption of children.
If the name change request is on behalf of a minor, consent may be required from the parent not filing the request. Note that if the name change is for a minor, the fingerprints of the adult petitioner must be taken and submitted, not the minor’s.

When filing for a name change at the courthouse, you must first go to Family Court Services in room 340 before 3:30 p.m. to have your pleadings reviewed and notarized.

The legal eviction process is made up of 3 essential steps:

24 Hour Writ of Possession
Contesting an Eviction
The tenant may petition the court to stay the eviction (halt further legal procedures) at the Orange County Clerk of Courts.
If the Judge grants you, the tenant, your request, the eviction is cancelled and you, the tenant, can remain in the property.
To proceed with the eviction after a cancellation, the plaintiff/landlord must file an “alias” Writ of Possession with the Orange County Clerk of Courts. A new $90.00 fee will be charged.

How does the Orange County Sheriff’s Office verify addresses?
We use the United States Postal Service (www.usps.com) and Orange County Property Appraiser (www.ocpafl.org)
I just had my 5 Day Eviction/Unlawful Detainer served; what happens next?
- After your 5 Day Summons for Eviction or Unlawful Detainer is served, you count 5 business days (Monday – Friday). On the 6th day, you are eligible to file for a 24 Hour Writ of Possession
- You can file for a 24 Hour Writ of Possession at the Clerk of Courts (Room 310) Monday-Thursday 7:30am until 10:00am
- Plaintiff/landlord must obtain the Writ of Possession from the Clerk of the Court and bring it to the Sheriff’s Office for service
I am serving multiple people at the same residence/business. Why do I have to pay for each person?
There is a service charge for each individual being served by the civil process server or deputy regardless of whether or not they share an address
- The 24 Hour Writ of Possession is the exception – the service fee is a flat rate of $90.00
Why do you need a phone number on my 24 Hour Writ of Possession?
- The deputy needs a valid phone number with voicemail features to set up the appointment for eviction
- At your appointment, you must be able to enter the property and change the locks or have a locksmith on site
I just paid at the Clerk of Courts; why am I paying again?
- The Clerk of Courts and the Sheriff’s Office are separate offices. The fees to file and the fees we charge to serve are different.
How does the eviction process work?
- There are 3 steps to the eviction process: 3 day notice, 5 Day Eviction/Unlawful Detainer, and 24 Hour Writ of Possession
- The Clerk of Courts (Room 310) sells a packet with all of the paperwork and you can file your eviction there
Can I serve my Summons, Notice to Appear, 5 Day Eviction/Unlawful Detainer, or 24 Hour Writ of Possession myself?
No. This would not be considered a legal service.
I have a 24 Hour Writ of Possession. Why is it taking so long to get served?
- A 24 Hour Writ of Possession is not to be taken literally; after it is posted the tenant has at least 24 hours before the eviction will be enforced.
- The deputy will call the landlord/plaintiff to set up the appointment at a later date.
- At your appointment you must be able to gain entry to the property and change the locks.
- You must have a locksmith present if you cannot gain entry to the property.
- If you are unable to gain entry at the time of your appointment, the 24 Hour Writ of Possession will be returned unexecuted (not served).
- You must then file an “Alias” 24 Hour Writ of Possession at the Clerk of Courts.
- You will be charged another $90.00 fee to attempt service again.
Why can’t I make changes on my 5 Day Eviction/Unlawful Detainer or 24 Hour Writ of Possession in the office?
- Our records must match what the Clerk of Courts has on file
- Any changes you make to a legal document must be rescanned and recorded by the Clerk of Courts (Room 310) before processing
